These Terms of Service (“Terms”) govern the use of the website and services provided by Artiste & Aura (“Artiste & Aura,” “Studio,” “we,” “us,” or “our”), an architecture and interior design studio based in Chennai, Tamil Nadu, India.

By accessing our website, contacting us, engaging our services, approving a proposal, making a payment, or otherwise proceeding with a project, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree with these Terms, please do not use our website or engage our services.


1. About Our Services

Artiste & Aura provides professional architecture and interior design services in Chennai for residential, commercial, hospitality, and other spaces.

Our services may include, but are not limited to:

  • Architectural design and planning
  • Residential architecture
  • Commercial architecture
  • Interior design
  • Residential interior design
  • Commercial interior design
  • Space planning
  • Concept development
  • Design consultations
  • 2D drawings and documentation
  • 3D modelling and visualisation
  • 3D renders and presentations
  • Material and finish selection
  • Furniture and lighting recommendations
  • Design detailing
  • Renovation and remodelling design
  • Project coordination
  • Site visits and design supervision, where specifically included
  • Styling and design consultancy
  • Other architecture and interior design services agreed upon in writing

The exact services, deliverables, project stages, fees, timelines, and responsibilities will be specified in the applicable proposal, quotation, invoice, work order, or written project agreement.

Services not specifically included in the agreed scope may be treated as additional services and may incur additional fees.


2. Consultation and Project Engagement

Initial consultations may be provided to understand the client’s requirements, project scope, budget, preferences, site conditions, and expected outcomes.

A project will be considered formally engaged only after the client accepts the applicable proposal or agreement and fulfils any required advance payment or other commencement requirements.

The Studio reserves the right to decline a project or discontinue discussions before formal engagement without being required to provide a reason.


3. Client Responsibilities

The client agrees to:

  • Provide accurate and complete information about the project.
  • Provide available architectural drawings, measurements, site information, photographs, documents, and other relevant information.
  • Clearly communicate project requirements, preferences, budget expectations, and constraints.
  • Provide timely feedback and approvals.
  • Provide reasonable access to the project site when required.
  • Make payments according to the agreed payment schedule.
  • Inform the Studio promptly about any changes to project requirements.
  • Obtain approvals, permissions, licences, or clearances that are outside the Studio’s agreed scope.
  • Ensure that materials, images, logos, documents, trademarks, or other content supplied by the client do not infringe the rights of third parties.

The Studio shall not be responsible for delays resulting from incomplete information, delayed approvals, lack of site access, delayed payments, or delayed decisions by the client.


4. Design Process

Depending on the project, the design process may include several stages, such as:

  1. Initial consultation and project briefing
  2. Site study and information gathering
  3. Concept development
  4. Space planning
  5. Design development
  6. Material and finish selection
  7. 3D visualisation and presentation
  8. Detailed drawings and documentation
  9. Final design approval
  10. Project coordination or supervision, where included

The number of design stages and deliverables will depend on the scope agreed upon for the individual project.

The Studio may proceed to the next stage after receiving the client’s approval for the previous stage.


5. Design Revisions and Changes

Artiste & Aura aims to accommodate reasonable revisions within the agreed project scope.

However, substantial changes to an approved design may be considered additional work.

Additional charges may apply where the client requests:

  • Major changes to an approved concept
  • Significant layout changes after approval
  • Repeated revisions beyond the agreed scope
  • Changes resulting from new requirements
  • Additional rooms or areas
  • Additional drawings or visualisations
  • Changes to previously approved materials or finishes
  • Redesign resulting from a change in project direction
  • Work outside the originally agreed scope

Any additional work may also require an extension of the project timeline.


6. Project Fees and Payments

Professional fees will be communicated through a proposal, quotation, invoice, or project agreement.

The client agrees to make payments according to the agreed payment schedule.

Unless otherwise stated in writing:

  • Work may begin after receipt of the required advance payment.
  • Each project stage may be subject to the applicable payment being received.
  • Outstanding payments may result in suspension of services.
  • Additional services will be charged separately.
  • Applicable taxes and statutory charges will be payable by the client.
  • The Studio may withhold further deliverables until outstanding payments are settled.

Payment terms specified in a project-specific agreement shall take precedence over general payment provisions in these Terms.


7. Refund and Cancellation Policy

Architecture and interior design services involve professional time, creative development, consultations, drawings, planning, documentation, and project-specific work.

Accordingly, fees relating to services already performed are generally non-refundable.

If a client cancels a project after work has commenced:

  • Fees for completed work shall remain payable.
  • Work already undertaken shall not automatically qualify for a refund.
  • Expenses or third-party costs already incurred for the project may be payable by the client.
  • Outstanding invoices shall remain payable.
  • Any refund, where applicable, will be determined according to the specific project agreement.

If the project-specific agreement contains separate cancellation or refund provisions, those provisions shall apply.


8. Project Timelines

The Studio will make reasonable efforts to meet the estimated timelines communicated to the client.

However, architecture and interior design projects may be affected by factors including:

  • Client approvals
  • Changes in requirements
  • Site conditions
  • Contractor availability
  • Vendor availability
  • Material availability
  • Delivery schedules
  • Government approvals
  • Third-party consultants
  • Technical issues
  • Construction conditions
  • Delays caused by the client or third parties

Unless expressly agreed otherwise in writing, project timelines are estimates and are not guaranteed completion dates.

The Studio shall not be responsible for delays caused by circumstances outside its reasonable control.


9. Site Measurements and Existing Conditions

Designs and drawings may be prepared using information, measurements, drawings, photographs, and other details provided by the client or collected during site visits.

Where site measurements are undertaken by the Studio, they are intended for design purposes and should be independently verified by the contractor or executing agency before construction, fabrication, or installation.

The Studio shall not be responsible for concealed structural conditions, undocumented services, inaccurate information provided by the client, or discrepancies discovered during construction or execution.

Contractors and fabricators remain responsible for verifying dimensions and site conditions before commencing work.


10. Contractors, Vendors and Third Parties

Unless expressly agreed otherwise, Artiste & Aura is an architecture and interior design studio and is not responsible for the independent performance of contractors, fabricators, suppliers, manufacturers, installers, consultants, or other third parties.

Where we recommend or coordinate with third-party vendors or contractors, those parties may operate under separate agreements.

The Studio shall not be responsible for:

  • Contractor workmanship
  • Manufacturing defects
  • Poor installation
  • Vendor delays
  • Material defects
  • Product availability
  • Delivery delays
  • Price changes by suppliers
  • Contractor disputes
  • Damage caused by third parties
  • Failure of a third party to perform its obligations

Where project management, coordination, or site supervision is included in our scope, the extent of those services will be specified in the relevant project agreement.


11. Materials, Products and Specifications

Material, furniture, fixture, lighting, appliance, hardware, and product recommendations are generally based on availability, suitability, design intent, quality, and the information available at the time of selection.

Product prices, specifications, availability, warranties, and delivery schedules may change without notice.

The Studio may recommend alternative products or materials when an originally selected item becomes unavailable or unsuitable.

Final purchases, warranties, manufacturer obligations, and product performance may be subject to the terms of the respective supplier or manufacturer.


12. Architectural Approvals and Statutory Permissions

Where required, projects may be subject to approvals from municipal authorities, planning authorities, housing associations, building authorities, fire authorities, or other governmental or regulatory bodies.

The Studio’s responsibility for obtaining such approvals shall depend entirely on the agreed scope of services.

The client remains responsible for providing accurate ownership documents, property information, legal documents, and other information required for applications.

The Studio does not guarantee that any particular planning permission, building approval, licence, or statutory clearance will be granted.


13. Intellectual Property Rights

All original creative and design materials developed by Artiste & Aura, including but not limited to:

  • Architectural concepts
  • Interior design concepts
  • Drawings
  • Sketches
  • Layouts
  • 3D models
  • Renderings
  • Design presentations
  • Details
  • Specifications
  • Design systems
  • Visual concepts
  • Other creative materials

remain the intellectual property of the Studio unless otherwise agreed in writing.

Upon full payment of the applicable project fees, the client receives the right to use the final approved design for the specific project for which it was created.

The client may not reproduce, resell, distribute, commercially exploit, or reuse the Studio’s designs for another project without prior written permission.

Editable/source files, including CAD files, 3D models, working files, and other production files, will only be provided where specifically included in the agreed scope.


14. Client-Supplied Materials

If the client supplies photographs, artwork, logos, drawings, trademarks, images, content, plans, or other intellectual property for use in a project, the client confirms that they have the necessary rights or permissions to use those materials.

The client agrees to indemnify the Studio against claims arising from the unauthorised use of client-supplied materials.


15. Portfolio and Photography Rights

Artiste & Aura may photograph, record, document, and display completed projects for professional portfolio, marketing, social media, website, publication, awards, competitions, and promotional purposes.

This may include photographs, videos, drawings, renderings, and other visual representations of the completed project.

The Studio will make reasonable efforts to avoid publishing confidential personal information of the client.

If a client requires complete project confidentiality, this must be communicated to the Studio in writing and agreed upon before publication or project completion.


16. Confidentiality

Artiste & Aura will treat confidential, non-public information received from clients with reasonable care.

The Studio will not intentionally disclose confidential client information to third parties except:

  • Where disclosure is required to perform the project;
  • Where disclosure is required by law;
  • Where disclosure is necessary to protect the Studio’s legal rights;
  • Where the information has become publicly available through no fault of the Studio; or
  • Where the client has provided permission.

Clients are also expected to keep confidential any proprietary methods, commercial information, design processes, documents, or other confidential information provided by the Studio.


17. Design Visualisations and Renderings

3D visualisations and renderings are representations of design intent and may not exactly represent final constructed conditions.

Differences may occur due to:

  • Lighting conditions
  • Screen settings
  • Material availability
  • Product substitutions
  • Manufacturing variations
  • Construction methods
  • Site conditions
  • Colour variations
  • Natural material variations

Renderings should therefore not be considered an exact guarantee of the final physical appearance.


18. Construction and Execution

Unless explicitly agreed in writing, Artiste & Aura does not undertake responsibility for construction execution.

The contractor or executing agency is responsible for:

  • Construction methods
  • Structural execution
  • Site safety
  • Labour management
  • Measurements before fabrication
  • Material handling
  • Installation
  • Workmanship
  • Compliance with applicable construction requirements

Any construction-related responsibility assigned to Artiste & Aura will be limited to the specific services expressly included in the project agreement.


19. Health and Safety

The contractor, site manager, or executing agency is responsible for maintaining appropriate health and safety standards at the project site unless otherwise agreed in writing.

Clients and third-party contractors must follow applicable safety requirements when accessing or working at the site.

Artiste & Aura shall not be responsible for injuries, accidents, or losses arising from unsafe acts or conditions caused by contractors, labourers, vendors, or other third parties outside the Studio’s direct control.


20. Suspension of Services

The Studio may temporarily suspend services where:

  • Payments are overdue;
  • Required information has not been provided;
  • Client approvals are significantly delayed;
  • Site access is unavailable;
  • The project is materially changed;
  • The client materially breaches these Terms;
  • The client engages in abusive, threatening, unlawful, or inappropriate conduct; or
  • Continuing the project would create unreasonable legal, professional, or operational risk.

Work may resume once the relevant issue has been resolved.


21. Termination

Either party may terminate the project subject to the terms of the applicable project agreement.

Artiste & Aura may terminate or suspend services if the client:

  • Fails to make required payments;
  • Materially breaches the agreed terms;
  • Repeatedly delays the project;
  • Provides materially false or misleading information;
  • Misuses the Studio’s intellectual property; or
  • Engages in unlawful or prohibited conduct.

Upon termination, the client remains responsible for all fees and costs incurred up to the effective date of termination.


22. Limitation of Liability

To the maximum extent permitted under applicable law, Artiste & Aura shall not be liable for indirect, incidental, special, consequential, or punitive losses arising from the use of our services.

The Studio shall not be responsible for losses arising from:

  • Contractor or vendor actions;
  • Third-party services;
  • Material or product defects;
  • Construction defects;
  • Delays caused by third parties;
  • Unforeseen site conditions;
  • Client-requested changes;
  • Incorrect information supplied by the client;
  • Failure to obtain approvals outside the Studio’s scope;
  • Natural events or circumstances beyond the Studio’s reasonable control.

The Studio does not guarantee any particular financial, commercial, rental, resale, investment, or business outcome resulting from its design services.

To the extent permitted by applicable law, the Studio’s total liability for any claim relating to a project shall not exceed the professional fees actually paid to Artiste & Aura for the specific services giving rise to that claim.


23. Indemnification

The client agrees to indemnify and hold harmless Artiste & Aura, its designers, employees, consultants, representatives, and agents against claims, losses, damages, liabilities, costs, and expenses arising from:

  • Breach of these Terms by the client;
  • Misuse of the Studio’s designs;
  • Unauthorised reproduction or modification of Studio materials;
  • Infringement caused by client-supplied materials;
  • Acts or omissions of contractors appointed by the client;
  • Unlawful use of our services; or
  • Violation of third-party rights by the client.

24. Force Majeure

Neither party shall be liable for a delay or failure to perform obligations caused by circumstances beyond reasonable control.

Such circumstances may include:

  • Natural disasters
  • Floods
  • Fire
  • Severe weather
  • Epidemics or pandemics
  • War
  • Civil unrest
  • Government restrictions
  • Strikes
  • Labour disruptions
  • Major supply-chain disruptions
  • Infrastructure failures
  • Other unforeseen circumstances

The affected party shall make reasonable efforts to notify the other party and resume performance when reasonably possible.


25. Website Content

The information published on the Artiste & Aura website is provided for general informational purposes.

We make reasonable efforts to keep website information accurate and current; however, we do not guarantee that all information, images, project descriptions, pricing, availability, or other content will always be complete, accurate, or up to date.

Project photographs, renders, drawings, and descriptions may represent completed projects, conceptual designs, or work in progress.


26. Third-Party Links

Our website may contain links to third-party websites, products, services, manufacturers, suppliers, or other resources.

Artiste & Aura does not control and is not responsible for the content, availability, privacy practices, or terms of third-party websites.

Accessing third-party websites is at the user’s own discretion.


27. Privacy

Any personal information collected through our website, enquiry forms, consultations, or project communications will be handled in accordance with our applicable Privacy Policy.

Clients should avoid submitting sensitive personal or confidential information through public website forms unless specifically requested.


28. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any dispute arising from or relating to these Terms or the services provided by Artiste & Aura shall, subject to applicable law, be subject to the jurisdiction of the competent courts in Chennai, Tamil Nadu, India.

The parties are encouraged to make reasonable efforts to resolve disputes amicably before initiating formal legal proceedings.


29. Amendments to These Terms

Artiste & Aura reserves the right to modify or update these Terms from time to time.

The updated version may be published on our website.

For ongoing projects, the terms contained in the applicable signed proposal, quotation, work order, or project agreement shall continue to govern the project to the extent they conflict with subsequently published general Terms, unless otherwise agreed in writing.


30. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be modified or removed only to the extent necessary.

The remaining provisions shall continue to remain valid and enforceable.


31. Entire Agreement

These Terms, together with the applicable proposal, quotation, scope of work, invoice, work order, and written project agreement, constitute the agreement between the client and Artiste & Aura concerning the applicable services.

If there is a conflict between these Terms and a specific written project agreement, the specific project agreement shall prevail to the extent of that conflict.
